This week, Bexar County Grand Juries handed down 335 felony indictments.
William Rivera is charged with murder. The indictment alleges that on March 13, 2022, Rivera intentionally and knowingly caused the death of Justin Gonzales by shooting at and in the direction of Gonzales with a deadly weapon (firearm). The Juvenile Division is prosecuting this case in the 289th District Court. Murder is a first-degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.
Celedino Saldana is charged in multiple separate indictments:
- Attempted capital murder of a police officer: This indictment alleges that on Aug. 5, 2022, Saldana intentionally and knowingly caused the death of Jose Claire by shooting at and in the direction of Claire with a deadly weapon (firearm), an act amounting to more than mere preparation that tended but failed to effect the commission of the offense of capital murder, having at the time the specific intent to commit the offense of capital murder, and Claire was a peace officer, who was acting in the lawful discharge of an official duty and Saldana knew Claire was a peace officer;
- Aggravated assault with a public servant: This indictment alleges that on Aug. 5, 2022, used and exhibited a deadly weapon (firearm) and Saldana intentionally and knowingly threatened imminent bodily injury to Nicholas Espinoza by shooting and in the direction of Espinoza with said deadly weapon, and Saldana knew Espinoza was a public servant, namely: a peace officer, while Espinoza was lawfully discharging an official duty as a public servant, and in retaliation and on account of Espinoza’s official power and performance of an official duty as a public servant;
- Aggravated assault with a public servant: This indictment alleges that on Aug. 5, 2022, used and exhibited a deadly weapon (firearm) and Saldana intentionally and knowingly threatened imminent bodily injury to Vince Gomez by shooting and in the direction of Gomez with said deadly weapon, and Saldana knew Gomez was a public servant, namely: a peace officer, while Gomez was lawfully discharging an official duty as a public servant, and in retaliation and on account of Gomez’s official power and performance of an official duty as a public servant;
The Criminal Trial Division is prosecuting these cases in the 227th District Court. Attempted capital murder of a police officer is a first-degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.
Ernest Garay is charged with failure to stop and render aid resulting in death. The indictment alleges that on July 7, 2022, Garay intentionally and knowingly drove a vehicle that became involved in an accident that resulted in death to Manuel Mendoza, and that Garay, knowing said accident had occurred, intentionally and knowingly failed to determine whether a person was involved in the accident and determine whether that person required aid, and that said accident resulted in the death of Mendoza. The Criminal Trial Division is prosecuting this case in the 399th District Court. Failure to stop and render aid resulting in death is a second-degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.
Sylvia Lopez is charged with intoxication manslaughter. The indictment alleges that on May 11, 2022, Lopez operated a motor vehicle in a public place while intoxicated, and did by reason of such intoxication cause the death of Irma Garcia Lozano by accident or mistake, by Lopez driving the motor vehicle into Lozano. The indictment also alleges that Lopez recklessly caused the death of Lozano by failing to drive the motor vehicle on the roadway, failing to keep a proper lookout, failing to apply the brakes in a timely manner, driving on a sidewalk, by Lopez failing to take necessary and proper evasive action, and by driving and operating a motor vehicle while under the influence of a controlled substance, a drug, a dangerous drug or a combination thereof, which acts and omissions resulted in the motor vehicle driven and operated by Lopez colliding into Lozano. The Criminal Trial Division is prosecuting this case in the 379th District Court. Intoxication manslaughter is a second-degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.
Maria Antoinette Nealy is charged in separate indictments:
- Manslaughter: This indictment alleges that on July 28, 2022, Nealy recklessly caused the death of April Longoria by discharging a deadly weapon (firearm) at and in the direction of the complainant;
- Felon in possession of a firearm: This indictment alleges that on July 28, 2022, Nealy, having been convicted of the felony offense of possession of a controlled substance PG 1 4 grams to 200 grams on May 18, 2018, did intentionally and knowingly possess a firearm before the fifth anniversary of Nealy’s release from confinement or release from supervision under community supervision, parole or mandatory supervision, following conviction of said felony.
The Criminal Trial Division is prosecuting these cases in the 187th District Court. Manslaughter is a second-degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.
An indictment is not a finding of guilt. A person charged by indictment is presumed innocent until found guilty beyond a reasonable doubt by a jury or a judge. Because these and potentially other cases are either pending or may be under investigation, we can make no further comment on them.
