Bexar County Grand Jury hands down indictments in family violence, child pornography cases

This week, Bexar County Grand Juries handed down 284 felony indictments.

Elijah Gonzales is charged in separate indictments:

  • Assault of pregnant person: This indictment alleges that on Aug. 24, 2021, Gonzales intentionally, knowingly and reckless caused bodily injury to the complainant, who Gonzales knew was pregnant at the time of the offense, and that Gonzales committed the offense by kicking the complainant with his foot, grabbing the complainant with his hand, pushing the complainant with his hand and pulling the hair of the complainant with his hand and fingers;
  • Violation of bond: This indictment alleges that on Jan. 14, 2022, Gonzales knowingly and intentionally violated a condition of bond set in a family violence case and related to the safety of the victim and the safety of the community issued in Bexar County, Texas, dated the 25th day of Aug., 2021, under Cause Number CM 089718, issued under the Texas Code of Criminal Procedure Art. 17.40, by intentionally or knowingly committing family violence against the complainant by striking the complainant with his hand; 
  • Burglary of a habitation with intent to commit assault: The first count of this indictment alleges that on March 21, 2022, Gonzales intentionally and knowingly entered a habitation, with intent to commit an assault, without the effective consent of the owner. The second count of the indictment alleges that on March 21, 2022, Gonzales knowingly and intentionally violated a condition of bond set in a family violence case and related to the safety of the victim and the safety of the community issued in Bexar County, Texas, dated the 25th day of Aug., 2021, under Cause Number CM 089718, issued under the Texas Code of Criminal Procedure Art. 17.40, by intentionally or knowingly committing family violence against the complainant by striking the complainant with his hand.

The Family Violence Division is prosecuting these cases in the 399th District Court. Burglary of a habitation with intent to commit assault is a second-degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.

Matthew Martin is charged in a multi-count indictment:

  • Possession of child pornography: 39 counts of the indictment allege that on July 29, 2021, Martin intentionally or knowingly possessed visual material that visually depicted, and which Martin knew visually depicted a child who was younger than 18 years of age at the time the image of the child was made, engaging in sexual conduct;
  • Stalking: This count of the indictment alleges that on July 7, 2021, Martin, pursuant to the same scheme and course of conduct directed specifically at the complainant, knowingly engaged in conduct that constituted an offense under Section 42.07 of the Texas Penal Code, namely: repeatedly sending electronic communications via text and e-mail, and that Martin’s conduct would cause a reasonable person to, and did cause the complainant to feel harassed, annoyed, alarmed, abused, tormented, embarrassed or offended; and that Martin placed a tracking device on the vehicle of the complainant on July 12, 2021 and on July 23, 2021, that Martin knew and reasonable believed the complainant would regard as threatening bodily injury or death for the complainant; and caused the complainant to be placed in fear of bodily injury or death or fear that an offense would be committed against the complainant’s property and would cause a reasonable person to fear bodily injury or death for the complainant.

The Public Integrity and Cyber Crime Division is prosecuting these cases in the 227th District Court. Possession of child pornography is a third-degree felony punishable by two to 10 years in prison and a possible fine of up to $10,000.

An indictment is not a finding of guilt. A person charged by indictment is presumed innocent until found guilty beyond a reasonable doubt by a jury or a judge. Because these and potentially other cases are either pending or may be under investigation, we can make no further comment on them.
