Bexar County Grand Juries hand down indictments in 3 separate murder cases

This week, Bexar County Grand Jurors handed down 279 felony indictments.

Enrique Lara is charged with murder. The indictment alleges that on Feb. 28, 2022, Lara intentionally and knowingly caused the death of Maria Virginia Hernandez by shooting Hernandez with a deadly weapon (firearm). The Family Violence Division is prosecuting this case in the 175th District Court. Murder is a first-degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000. 

Michael Montoya is charged with murder. The indictment alleges that on March 13, 2022, Montoya intentionally and knowingly caused the death of Paul Butler by shooting Butler with a deadly weapon (firearm). The Criminal Trial Division is prosecuting this case in the 187th District Court. Murder is a first-degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000. 

Juan Antonio Trevino is charged in two separate indictments:

  • Murder: The indictment alleges that on March 6, 2022, Trevino intentionally and knowingly caused the death of Eric Cuellar by shooting Cuellar with a deadly weapon.
  • Unlawfully carrying a weapon w/felony: The indictment alleges that on March 6, 2022, Trevino intentionally, knowingly and recklessly carried a handgun on or about his own person, and Trevino was not on his own premises or premises that were under his own control, and Trevino was not inside or directly en route to a motor vehicle or watercraft that was owned by Trevino or under his control, and that Trevino was prohibited from possessing a firearm under Section 46.04(a) of the Texas Penal Code, in that at the time of the commission of the charged offense, Trevino had been previously convicted of the felony offense of aggravated assault on a public servant on Dec. 3, 2009, and that Trevino’s possession of the firearm occurred after the fifth anniversary of Trevino’s release from “confinement” or “from supervision under community supervision” or “from supervision under parole” or “from supervision under mandatory supervision” following conviction of the felony , and that Trevino possessed the firearm at 115 Allsup, San Antonio, Texas, which was a location other than the premises at which Trevino lived.

The Criminal Trial Division is prosecuting these cases in the 175th District Court. Murder is a first-degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000. 

Stefani Johnson is charged with theft from $30,000 to less than $150,000. The first count of the indictment alleges that from March 30, 2015, through Aug. 17, 2018, Johnson, with intent to deprive the owner, who was then and there an elderly individual, of property, namely: lawful currency of the United States of America, did unlawfully, without the consent of the owner appropriate the property by acquiring or otherwise exercising the control over the property which had a value of $30,000 or more but less than $150,000, and all the amounts alleged were pursuant to one scheme or continuing course of conduct. The second count of the indictment alleges that on March 30, 2015, through Aug. 17, 2018, for monetary or personal benefit, profit or gain, Johnson intentionally or knowingly or recklessly caused the exploitation of an elderly person by the illegal or improper use of resources of the complainant by depriving the complainant of lawful currency of the United States of America without the consent of the complainant. The Elder Fraud Division is prosecuting this case in the 175th District Court. Theft from $30,000 to less than $150,000 is a second-degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.

An indictment is not a finding of guilt. A person charged by indictment is presumed innocent until found guilty beyond a reasonable doubt by a jury or a judge. Because these and potentially other cases are either pending or may be under investigation, we can make no further comment on them.
