Pair indicted for Jan. 2022 murder

This week, Bexar County Grand Juries handed down 329 felony indictments.

Felix Hernandez and Stacy Mae Lynn Page are charged in separate multi-count indictments. The first count of the indictment is for murder. It alleges that on Jan. 22, 2022, Hernandez and Page intentionally and knowingly caused the death of Victoria Stampley by shooting Stampley with a deadly weapon (firearm). The second count of the indictment is for engaging in organized criminal activity. It alleges that Hernandez and Page, with the intent to facilitate their own flight after the commission of a felony (aggravated assault with a deadly weapon), intentionally and knowingly abducted another person (Stampley) by secreting and holding Stampley in a place where she was not likely to be found and without Stampley’s consent did restrain her so as to interfere substantially with her liberty by moving Stampley from one place to another. Hernandez and Page are also accused of knowing that an investigation was pending, to-wit the investigation of a the shooting of a female, the pair intentionally and knowingly concealing a purse, handgun and human blood with intent to impair its verity, legibility and availability as evidence in the investigation. The Criminal Trial Division is prosecuting these cases in the 379th District Court. Murder is a first-degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.

Brandon Lerma and Ernest Tavera are charged in separate multi-count indictments.

  • Murder: This indictment alleges that on Jan. 30, 2022, Lerma and Tavera intentionally and knowingly caused the death of Vincent Garcia by cutting and stabbing Garcia with a deadly weapon (object unknown to the Grand Jury) that in the manner of its use and intended use was capable of causing death and serious bodily injury.
  • Engaging in organized criminal activity: This indictment alleges that on Jan. 30, 2022, Lerma and Tavera, as members of a criminal street gang, intentionally and knowingly committed the offense of murder by causing the death of Vincent Garcia by cutting and stabbing Garcia with a deadly weapon (object unknown to the Grand Jury).

The Criminal Trial Division is prosecuting these cases in the 227th District Court. Murder is a first-degree felony punishable by 5 to 99 years or life in prison and a possible fine of up to $10,000.

Dezaraie Lynn Mrazek is charged in multiple indictments.

  • Super aggravated sexual assault of a child: This indictment alleges that on April 10, 2021, Mrazek intentionally and knowing caused the penetration of the sexual organ of a child who was younger than 6 years.
  • Possession of child pornography: The seven-count indictment alleges that Mrazek intentionally or knowingly possessed visual material that visually depicted, and which Mrazek knew visually depicted a child who was younger than 18 years of age at the time the image of the child was made, engaging in sexual conduct.
  • Bestiality: The two-count indictment alleges that on Jan. 1, 2022, Mrazek knowingly engaged in an act involving contact between Mrazek’s genitals and the mouth of an animal (dog) and Mrazek’s conduct was not a generally accepted or lawful animal husbandry or veterinary practice.
  • Possession/promotion of lewd visual material of a child: This indictment alleges that on Feb. 1, 2022, Mrazek knowingly possessed visual material that depicted the lewd exhibition of the pubic area of a partially clothed child who was younger than 18 years of age at the time that the visual material was created, and said visual material appealed to the prurient interest in sex and had no serious literary, artistic, political or scientific value.

Mrazek’s co-defendant, Jose Tovar is charged in the following indictments.

  • Super aggravated sexual assault of a child: This indictment alleges that on April 10, 2021, Mrazek intentionally and knowing caused the penetration of the sexual organ of a child who was younger than 6 years.
  • Possession of child pornography: The seven-count indictment alleges that Mrazek intentionally or knowingly possessed visual material that visually depicted, and which Mrazek knew visually depicted a child who was younger than 18 years of age at the time the image of the child was made, engaging in sexual conduct.

The Public Integrity and Cyber Crime Division is prosecuting these cases in the 399th District Court. Super aggravated sexual assault of a child is a punishable by 25 to 99 years or life in prison and a possible fine of up to $10,000.

Lex Luis Bazan is charged in a two count indictment with sexual assault of a child. The indictment alleges that on March 1, 2021, Bazan intentionally and knowingly penetrated the sexual organ of a child who was younger than 17 years of age and not the spouse of the defendant with the sexual organ of Bazan. The Family Violence Division is prosecuting this case in the 226th District Court. Sexual assault of a child is a second-degree felony punishable by 2 to 20 years in prison and a possible fine of up to $10,000.

Matthew Mireles is charged in two separate indictments with possession of a deadly weapon in a penal institution. Both allege that on Feb. 9, 2022, Mireles, while confined in a penal institution (the Bexar County Adult Detention Center) intentionally and knowingly carried on or about his person a deadly weapon (flat metal shank) that in the manner of its use and intended use was capable of causing death and serious bodily injury. Mireles is awaiting trial on charges of aggravated assault against a public servant, interfering with a police service animal by recklessly killing it and evading arrest/detention with a vehicle. Those cases stem from a Jan. 25, 2019, incident. The Criminal Trial Division is prosecuting these cases in the 175th District Court. The new charges are third-degree felonies punishable by two to 10 years in prison and a possible fine of up to $10,000.

An indictment is not a finding of guilt. A person charged by indictment is presumed innocent until found guilty beyond a reasonable doubt by a jury or a judge. Because these and potentially other cases are either pending or may be under investigation, we can make no further comment on them.
