[ARCHIVED] 04/13/2016 - Former BCSO Detention Officer Indicted for Sexual Assault

San Antonio, Texas, April 13, 2016: Yesterday, a Bexar County Grand Jury indicted former BCSO detention officer Erick Montez, age 35, for the charges of Sexual Assault and Improper Sexual Activity with Person in Custody.

The charges stem from an alleged incident that occurred outside the Bexar County Jail in December 2015. Montez, who was on-duty at the Bexar County Jail as a detention officer, was transporting a female inmate when he allegedly forced her into a Sheriff’s Office van in the parking lot and sexually assaulted. Under questioning, Montez claimed it was consensual sex, however, the victim stated she was sexually assaulted. An investigation later revealed surveillance video supported the victim’s allegations.

Sexual Assault is a 2nd degree felony, punishable by 2-20 years in prison and up to a $10,000.00 fine. Improper Sexual Activity with Person in Custody is a State Jail Felony, punishable by 180 days to two years in state jail and up to a $10,000.00 fine. The cases, which are currently pending out of the 144th District Court, will be prosecuted by the District Attorney’s Office Public Integrity Unit.
