Marijuana Declination
District Attorney Gonzales implemented a Marijuana Declination Policy in May 2019. Under that policy, the Bexar County District Attorney’s office will decline to prosecute misdemeanor marijuana offenses that are 1 oz. or less, unless there is a risk to public safety. By declining to prosecute these cases the county and taxpayers have avoided millions of dollars in booking costs.
DECLINATION OF LESS THAN .25 GRAMS
Additionally, the Bexar County District Attorney's Office will not prosecute possession of a penalty group 1 controlled substance case when the amount is less than .25 grams.
By declining to prosecute less than 1 oz. of marijuana and less than .25 grams of penalty group 1 drug cases criminal justice offices in Bexar County can focus their resources on fighting violent crimes, especially family violence offenses.
