Probate Courts of Bexar County

The Probate Court system is divided into two separate courts with each Probate Court headed by an elected judge. The Bexar County Probate Courts are tasked with:

  • Probating the wills of deceased persons
  • Declaring the heirs of deceased persons who die without a will
  • Establishing guardianships for incapacitated persons
  • Handling court-ordered mental health cases (Probate Court 1)

Probate is the legal proceeding by which the court determines the validity of a will, creates an administration in cases where the deceased did not leave a will, and/or determines the legal heirs of a deceased person. Additionally, the probate court establishes guardianships for incapacitated persons and minors; supervises the administration of the estates of deceased persons, incapacitated persons, and minors; hears matters involving inter vivos, testamentary, and charitable trusts; hears all cases involving civil mental health commitments; and eminent domain cases.
